Article of Agreement

The State of Texas, County of Panola
This article of agreement entered into this the 7th day of May AD 1851 between D. McNair of the one part and W. W. McCartney, S.B. Darnall, A.B. Davis, A.D. Irwin and John M. Parker building committee constructing on the part and for Carthage Lodge # 77 of the other part witnesseth that the said McNair on his part ________________ and agrees to furnish all the materials to wit - hewn timbers, sawed lumber, shingles, nails, __________ and build, construct and erect a House in the Town of Carthage, on Lot # 117. Said House to be constructed according to a plan or specification hereto annexed and made part of this agreement. The said McNair is also to furnish the said house with furniture as specified in same plan, the said house to be completed according to said plan or specification by the 25th day of December 1851. In consideration of said services to be performed by the said McNair the said W.W. McCartney, S.B. Darnall, A.B. Davis, A.D. Davis and John Parker Committee constructing as aforesaid premises in their part to deliver over to the said McNair immediately a subcription which has been raised for the purpose of erecting said House amounting to five hundred and eight-two dollars, giving to the said McNair full and entire control over said subscription to collect the same and appropriate it to his own use with the understanding that it is to be so much money paid to him in past satisfaction of the above mentioned services the said Committee as aforesaid further promises to pay to the said McNair on the first day of June AD 1851 the sum of $125.00 and on the twenty fifth day of December AD 1851 the said Committee as aforesaid is to pay to the said McNair the sum of $118.50 dollars and on the 25th day of December AD 1852 the said Committee as aforesaid is to pay to the said McNair the further sum of $400.00 dollars amounting in all to $1,226.00 which said sum of twelve hundred and twenty-six dollars to be paid at the time and in the manner above specified is to be in entire satisfaction for the above mentioned services to be performed by the said McNair.

Window frames to be made of 2 inch lumber cased on the inside and twenty eight in number to be completed.
Two doors in front below formed like the windows to be 4-1/2 feet wide, nine feet long, to be closed with folding panel shutters, Shutters to be 7 feet long with transoms above one door frame 3-1/3 feet wide, 7 feet high to be placed on the south side near the S.W. corner to be closed with panel shutters, said doors to be fastened with substantial knob locks, weather boarding to be dressed and put on in a workman-like manner.
Boxing to be plain with bed mould.
Lower floor to be laid with 1-1/2 inch plank kiln dried and tongued and grooved.

Said lower room to be furnished with a temporary pulpit and twenty seats 12 feet long,
one flight of Stairs to commence at the ground on the outside to pass through a door at the South West corner and extend up to the second floor.
The upper floor to be laid with 1-1/2 inch plank kiln dried dressed tongued and grooved
One partition to run across the West angle and cutting of ten feet. The doors in said partition 3-1/3 feet by 6-1/2 feel to be closed with panel shutters and fastened with knob latches.
One partition cutting off ten feet forming a room ten feet square in the North West corner with one door 3-1/3 feet - 6-1/2 closed with a panel door fastened with a knob latch.
Said rooms to be furnished with three stands. One stand to be three steps high with two columns with an arch. 2nd 2 steps high. The 3rd one step high. Said stands to be worked with panel work in front. The first stand to be six by four feet - 2nd and 3rd four feet square.
I do certify that the foregoing is a true copy of the plans of the Masonic Hall as on file in my office this the 11th day of June AD 1851

Know all men by these presents that I, W.W. McCartney, for and in consideration of the sum of twenty-four dollars to me paid, the receipt whereof is hereby acknowledged, have conveyed, bargained and sold, and do by the presents bargain, sell, alien, convey and release unto Duncan McNair as the Worshipful Master of Carthage Lodge No. 77 of Free and Accepted Masons and S.B. Darnall as Senior Warden and J.J. Lindsey as Junior Warden of said Lodge No. 77 for the use of said Lodge and to their successors in office all that certain parcel of land situated in the town of Carthage Texas as being part of Lot No. (117) one hundred and seventeen on the map of said Town, also being the North part of said Lot.
Beginning at a stake in the North East Corner of said Lot No (117), Thence _____ 10, East with East Street 323-1/2 feet stake. Thence South 80 (degrees) West at 404-1/6 feet stake on Main Street. Thence North 10 (degrees) West at 323-1/2 stake the North West corner of said Lot No. 117. Thence North 80, East with Wellington Street at 404 1/6 feet to the place of Beginning.
Containing three acres of Land together with all and singular, the rights members heradetaments and appurtenances to the same belonging in any wise appertaining to have and to hold all and singular the premises above mentioned unto the said McNair, Darnall and Lindsey and their successors in office for the use of said Lodge No. 77 forever. And I do hereby bind myself, my heirs, Executors and Administrators to warrant and forever defend all and singular the said premises unto the said McNair, Darnall and Lindsey and their successors for the use of said Lodge Nol 77, against every person whomsoever lawfully claiming or to claim the same or any part thereof. Witness my hand and seal this the __ of July AD 1851.

Know all men by these presents that we Sihon House as Worshipful Master and Samuel B. Darnall as Senior Warden and Wm. P. Anderson as Junior Warden of Carthage Lodge No. 76 on the part of said Lodge and for said Lodge for and in Consideration of the sum of four hundred dollars paid to said Lodge by Carthage Chapter No. 28 of Royal Arch Chapter Masons, the receipt of which is hereby acknowledged, have this day and do by these presents bargain, sell, alien and Convey unto Nathan Davis, as Most Excellent High Priest and H.P.C. Dulany as Excellent King and J.M. Parker as Excellent Scribe and their successors in office for the use of said Chapter, an undivided half of the upper story of the Masonic Hall in the town of Carthage, to be held by said Davis, Dulany and Parker as aforesaid and their successors for the use of said Chapter, free from interruption and molestation forever, hereby warranty the enjoyment of said undivided half of said House to the said Davis, Dulany and Parker as aforesaid to be used by them and their successors forever in Common with said Carthage Lodge.

Fyke, one of the subscribing witnesses, the witnesses to the instrument of writing and by me duly sworn according to Law, deposes and says that he saw S. House, S.B. Darnall and Wm. P. Anderson, whose names appear to said instrument, that he and S.B. Lacy signed the same as witnesses at the said House, Darnall and Anderson.

Know all men by these presents that we C.S. Scruggs and M.C. Scruggs, wife of the said C.S. Scruggs, of the County of Panola in the State of Texas and Town of Carthage for and in consideration of the sum of One Hundred Dollars to us in hand paid by Haston
Twomey, Most Excellent High Priest, King and Scribe of Carthage Chapter No 28 Royal Arch Masons, the receipt of which is hereby fully acknowledged, have granted, sold and conveyed and by these presents do grant, sell and convey unto the said Haston Twomey, Most Excellent and High Priest - King and Scribe of Carthage Chapter No. 28 Royal Arch Masons and his successors in office for the use of said Chapter of Royal Arch Masons situated in the Town of Carthage in the County of Panola in the State of Texas all that certain tract or parcel of land to wit: Standing in Panola County Texas as part of the Headright of George Goodwin, situated in the south part of the Town of Carthage and described as follows, to wit:
Beginning at the North East corner of the GraveYard at a Black Jack 13 __ South 89 E 5 to marking X. Thence North 80 East 100 to a stake. Thence South 10 East 122 to a stake. Thence South 80 West 100 to a stake from which a ____ _____ 313W 13 to X. Thence North 10 West 112 to the place of Beginning.
To have and to hold the above described premises together with all any singular the rights to any appurtenances there in anywise belonging unto the said Haston Twomey, Most Excellent High Priest, King and Scribe of Carthage Chapter No. 28 Royal Arch Masons and his successors in office or their legal assigns or successors forever. And we do hereby bind ourselves and heirs, Executors and Administrators to warrant and forever defend all and singular the said premises unto the said Haston Twomey, Most Excellent High Priest, King and Scribe of Carthage Chapter No. 28 Royal Arch Masons, and his successors in office for the use of ___ Chapter and defending their successors or legal assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.

Scruggs, known to me to be the persons who are named and subscribed to the foregoing Deed as Grantors who acknowledge to me that they executed the same for the purposes and considerations therein expressed and the said M.C. Scruggs having been examined by me privately and apart from her said husband and having the same fully explained to her, she, the said M.C. Scruggs, acknowledges the instrument to be her act and deed and declares that she had willingly signed the same for the purposes and considerations therein expressed and that she wishes not to retract it.

Know all men by these presents that M.D.N. Brown as President of the Farmers Alliance Corporation Mercantile Association of Panola County Texas and S.T. Hooker and W.R. Anderson as a committee hereof on the 20th day of April 1895 appointed to sell the hereinafter described land and the other persons whose names are subscribed hereto as stock or share holders in said corporation for and in consideration of the sum on Four Hundred Dollars ($400.00) paid and continuing to be paid as follows: One Hundred and Fifty Dollars cash in hand paid the receipt of which is hereby fully acknowledged and (1) promissory or Vendors Lien Note bearing even dates herewith for the sum of Two Hundred and Fifty ($250.00) dollars are due payable December the 31st, 1901 with 10% interest per annum from date. Have this day bargaining, sell and convey unto T.P. Hull High Priest of Carthage Chapter No. 28 and W.P. Lawrence Worshipful Master of Carthage Lodge No. 521 and their successors in office the following described property, to wit: Lot No. 93 situated in the Town of Carthage lying immediately South of and fronting on Sabine Street, 50 feet and running back south 100 feet designated upon the map of the Town of Carthage as Lot No. 93. Said lot of land being the same lot of land heretofore sold to said Farmers Alliance Corporation Mercantiles Association by a.H. Baker Sr. and A.H. Baker, Jr. on the 18th day of November 1899, the deeds therefore being recorded in the Records of Deed in and for Panola County Texas Book T, pages 307, 308,309 to have and to hold, the above described premises together with all and singular the rights and appurtenances thereto in any means belonging to the said T.P. Hull as High Priest of Carthage Chapter No. 28 and W.P. Lawrence Worshipful Master of Carthage Lodge No. 521 and their successors in office (as fully and completely as we can by reason of the authority vested in us to make this a deed) against the claims of every person whomsoever lawfully claiming or to claim the same or any part thereof. It is understood and agreed that the Vendors Lien and deed is hereby intended to secure the full and prompt payment of the note herein before mentioned together with an accumulated interest thereon _____ before signing.
In testimony where we have hereunto subscribed our names on this the 31st day of December AD 1900
