I, J. H. Burns, hereby make application to the Commissioner of Pensions for a pension to be granted me under the Act passed by the 83rd Legislature of the State of Texas, and approved April 17, 1913, on the following grounds:
I enlisted and served in the military service of the Confederate States during the war between the States of the United States, and that I did not desert the Confederate service, but during said war I was loyal and true to my duty, and never at any time voluntarily abandoned my post of duty in the said service; or (that I was in the service of the State of Texas during the war, to protect said State against the Indians and Mexicans for more than 6 months). That I was honorably discharged or surrendered at Appomattox Courthouse April 10, 1865. That I have been a bona fide citizen of this State since prior to January 1, A.D. 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not hold any National, State, city or county office which pays me a salary or fees of $300.00 per annum, nor have I an income from any other employment or other source whatever which amounts to $300.00 per annum, nor do I own in my own right, nor does any one hold in trust for my benefit or use, nor does my wife own, nor does any one hold in trust for my wife, estate or property, either real, personal or mixed, either in fee or for life, of the assessed value of over one thousand dollars, exclusive of a home of the value of not more than $1000.00; nor do I receive any aid or pension from any other State, of from the United States, or from any other source, and that I am not an inmate of the Confederate Home, and I do further state that the answers given to the following questions are true:

Wood, who are personally known to me to be credible citizens, who being by me duly sworn on oath, state that they personally know J. H. Burns, the above named applicant for a pension, and that they personally know that the said J. H. Burns has been a bona fide resident citizen of the State of Texas since prior to January 1, A.D., 1900, and that they have no interest in his claim.

Before me, J. P. Fant, County Judge of Cass County, State of Texas, on this day personally appeared Jas. N. Simmons and J. C. Cromer who are personally known to me to be credible citizens, who being by me sworn, on oath state that they are personally acquainted with the foregoing applicant, and that the facts set forth and statements made in his application are correct and true, to the best of their knowledge and belief, and that they have no interest in his claim, and said applicant's havits are good and free from dishonor. And we further make oath to the following facts touching the applicant's service in the confederate Army:
I, J. N. Simmons have known J. H. Burns all his life. I first knew him in Anderson Co., SC, where he was raised. I know he served in the Confederate Army. He was in the same division that I was in. I am now 73 yrs old and he is 69. He made a good soldier and was honorably discharged.
I, J. C. Cromer have known J. H. Burns all of his life and was in Comp D, 2nd SC Rifles with him. I served 18 months or more with him. He was discharged at Appomatox Courthouse April 10, 1865.

Certificate of State and County Assessor
I, W. C. Wiliams, State and County Assessor in the County of Cass, State of Texas, do certify that J. H. Burns, or his wife, or his trustee, or trustee for his wife, whose name is signed to the foregoing application for a pension, under the Act of the Thirty-third Legislature, approved April 7, 1913, is charged on the tax rolls of said county with a homestead of the value of $620.00 dollars, and of other property, real or personal, or both of the value of $180 dollars.

Application for Mortuary Warrant

I, Mrs. Addie Burns, do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late J. H. Burns, who was a pensioner of the State of Texas, and whose file number was 23464 and whose original county was Cass.
The said pensioner J. H. Burns, died on the 19 day of Nov. 1920, in the town of Lanier County of Cass, Texas.
The pensioner died in the home of his own, who was related to the pensioner as wife.
That the warrant, which application is hereby made for shall be applied to paying all or part of the funeral expenses incurred by the said pensioner Mrs. Addie Burns.
I further certify that the warrant for the current quarter has not been cashed by the pensioner, to the best of my knowledge and belief.
I am related to the pensioner as wife , that my home is in the town of Lanier, County of Cass, State of Texas, that my post office address is Linden, Texas, R1.

I, J. C. Fant, do certify that I am undertaker in the town of Linden, County of Cass, State of Tex, that I had charge of the body of J. H. Burns, who died in the town of Lanier, County of Cass, State of Tex on the 19 day of Nov 1920. That said body was prepared for burial by me on the 19 day of Nov 1920. That said body was buried in the Lanier Cemetery, which is located in the County of Cass, State of Texas, and that I am of the opinion that warrant herein applied for should be issued to the said Mrs. Addie Burns, who makes the foregoing application.

I, Dr. O. R. Taylor, do certify that I am a practicing physician, and that I attended J. H. Burns is his last illness and am of the opinion that his ailments were Tuberculosis.
I further certify that I am of the opinion that the Mortuary Warrant above requested should be issued in the name of the aforementioned applicant, in accordance with Act passed by the Thirty-fifth Legislature, and approved March 2, 1917.

I, Mrs. Addie Burns do hereby make application to the Comptroller of Public Accounts for a pension, to be granted me under the Act passed by the Thirty-third Legislature of the State of Texas, and approved April 7, A.D. 1913, on the following grounds:
I am the widow of J. H. Burns, deceased, who departed this life on the 19 day of Nov., A.D. 1920 in the county of Cass in the State of Texas.
I have not remarried since the death of my said husband, and I do solemnly swear that I was never divorced from my said husband, and that I never voluntarily abandoned him during his life, but remained his true, faithful, and lawful wife up to the date of his death. I was married to him on the 23rd day of April A.D. 1905 in the county of Cass, in the state of Texas.
My husband, the said J. H. Burns, enlisted and served in the military service of the confederate States during the war between the States of the United States, and that he did not desert the Confederate service. I have been a resident of the State of Texas since prior to January 1, A.D., 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not receive from any source whatever money or other means of support hold in trust for my benefit or use, estate, or property, either real, personal or mixed, either in fee or for life, of the value of one thousand dollars, exclusive of the home of the value of not over $1000; nor do I receive any aid or pension from any other state, or from the United States, or from any other source, and I do further state that the answers given to the following questions are true:

Dear Madam:
Your application for a Confederate pension has been received and filed, but cannot be approved on account of your age and the date of your marriage to Mr. Burns. The pension laws of this state now require that a widow applicant must have been born prior to the close of the year 1861 and that she must have been married prior to January 1, 1900, to the man on whose service record pension is applied for. Your application places your age at forty-seven years, indicating that you were born much later than the year 1861 and it is shown that you were married to Mr. Burns in 1905.
I regret that I cannot approve your application at this time, but same will be kept on file in this office and may be renewed whenever the constitution and general laws of this state are amended so as to permit the approval of same.
