ARTICLES OF AGREEMENT

Whereas, I, Andrew P. Flanagin, late a <blank> in Company G, of the 1 Regiment of Ala. Cav.
Volunteers, war of 1861 and 1865, having made application for pension under the Act of June 27, 1890:
Now this agreement witnesseth: That for and in consideration of services done and to be done in the
premises, I hereby agree to allow my attorney GEORGE E. LEMON, of Washington, D. C., the fee of ten
dollars, which shall include all amounts to be paid for any services in the furtherance of said claim; and
said fee shall not be demanded by or payable to my said attorney, in whole or in part, except in case of the
granting of my pension by the Commissioner of Pensions; and that the same shall be paid to him in
accordance with the provisions of Sections 4768 and 4769 of the Revised Statutes, U.S. and Section 4, Act
of Congress approved June 27, 1890.

COMMISSIONER OF PENSIONS.
SIR: Herewith is transmitted to you a letter from the Executors of the last will, &c., of George E. Lemon,
deceased, stating that it is their desire to do all they can to promote the interests of the claimants who were
decedent's clients at the date of his death, by such means as may be satisfactory to the Government, and as
far as possible to secure to his estate the benefits of the services he has rendered, and for that purpose they
desire to have these cases prosecuted by Alva S. Taber.
To that end they submit a form of Power of Attorney to be executed by said claimants, together with a
circular letter, to be mailed from said executors to each claimant, which, under the circumstances and the
good standing of Alva S. Taber, are approved by me.
You will, therefore, recognize Alva S. Taber in each case, in accordance with the existing practice of your
office, in which the claimants shall have executed said Power of Attorney.

POWER OF ATTORNEY

Know all Men by These Presents, That I, Andrew P. Flanagin, of Fredonia, County of Mason, in the State
of Texas, have made, constituted and appointed, and by these presents do make, constitute and appoint
Alva S. Taber, of the City of Washington, in the District of Columbia, my true and lawful Attorney, for me
and in my name, place and stead, hereby annulling and revoking all former Powers of Attorney or
authorizations whatever in the premises, to prosecute my claim for Pen. Ctf. No. 684050 as late Pvt. Co. G
1 Ala. Cav. under the Act of June 27, '90 and July 14, '62.
And to furnish, from time to time, any further evidence necessary or that may be demanded, giving and
granting to my said Attorney full power and authority to do and perform all and every act and thing
whatsoever requisite and necessary to be done in and about the premises, as fully to all intents and purposes
as I might or could do if personally present at the doing thereof-hereby transferring to the said Alva S.
Taber all rights heretofore granted to George E. Lemon as such Attorney; and I hereby request that the said
Alva S. Taber be substituted in the place of the said George E. Lemon in any articles of agreement as to
fees heretofore executed by me in favor of the said George E. Lemon-with full power of substitution and
revocation, hereby ratifying and confirming all that my said Attorney, or his substitute or legal
representative, may or shall lawfully do or cause to be done by virtue hereof.

IN WITNESS WHEREOF, I have hereunto set my hand and seal this 8th day of February, A.D. 1897.

appointed true and lawful attorney for Andrew P. Flanagin, late of Co. G, 1 Regt., Ala. Vols., who is a
claimant for Inv. Pension, which claim is entitled in the name of Andrew P. Flanagin for Inv. Pens. Act of
July 14, 1862 certificate numbered 684050 being duly empowered thereby to do and take all lawful ways
and means in said claimant's name and generally to do all and every other act or thing , under the laws or
regulations, whatsoever is necessary and needful to be done, and also conferring upon me full power of
substitution authorizing me to substitute another Agent or Attorney in my place and clothing him with the
same powers and benefits which I derived from the said claimant, through said power of attorney,
Now, therefore, I hereby constitute, appoint and substitute in and for myself, as such attorney in fact for the
said claimant, MILO B. STEVENS & CO., of Washington, D.C., duly qualified and recognized attorneys
before the Interior Department, as my substitute and hereby clothe them with the same duties in said claim
and the same rights in fee agreements as I acquired and now possess under the said power of attorney by
the act of the claimant, and denude myself of the same, hereby ratifying and confirming all that the said
attorneys as my substitute shall lawfully do or cause to be done by virtue hereof and by virtue of the power
of attorney granted to me as aforesaid.

COUNTY OF MASON

On this 25 day of November, A. D. one thousand eight hundred and eighty nine personally appeared before
me County Clerk, of the County Court, a court of record within and for the County and State aforesaid,
Andrew P. Flanagin, aged 43 years, a resident of Fredonia, County of Mason, State of Texas, who being
duly sworn according to law, declares that he is the identical Andrew P. Flanagin who entered service
under the name of Andrew P. Flanagin on or about the 24 day of April 1864 as Pvt. in company "G." of the
1st regiment of Ala. Cav. commanded by Geo. E. Spencer and was DISCHARGED at Huntsville, Ala., on
or about the 20th day of Oct., 1865, by reason of Special order #28, that his personal description is as
follows: Age, 43 years; height, 5 feet 10 inches; complexion, fair; hair, light; eyes, blue. That while a
member of the organization aforesaid, in the service and in the line of his duty at Kennesaw Mt., in the
State of Ga., on or about the <blank> day of May, l864, he contracted disease of eyes from exposure. That
he was treated in hospitals as follows: <blank>. That he has not been employed in the military or naval
service otherwise than as stated above. That since the 20th day of Oct., A.D. 1865, he has not been
employed in the military or naval service of the United States. That since, leaving the service his
occupation has been that of farmer. That prior to his entry into the service above named he was a man of
good, sound, physical health, being when enrolled a farmer. That he is now partially disabled from
obtaining his subsistence by manual labor by reason of his injuries above described, received in the service
of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid
pension roll of the United States.

He hereby appoints, with full power of substitution and revocation, GEORGE E. LEMON, OF
WASHINGTON, D.C., his true and lawful Attorney, to prosecute his claim. That he has never received or

years, a resident of Fredonia, County of Mason, State of Texas, who being duly sworn according to law,
declares that he is the identical Andrew P. Flanagin, who entered service during the War of the Rebellion
under the name of Andrew P. Flanagin on or about the 24 day of April, 1864, as Pvt. in company G of the 1
regiment of Ala. Cav. commanded by Ed Colleigh, and was HONORABLY DISCHARGED at Huntsville,
Ala., on or about the 20 day of October, 1865, by reason of Special order no. 28, that his personal
description is as follows: Age, 45 years; height, 5 feet 10 inches; complexion, fair; hair, light; eyes, blue.
That he is now suffering from sore eyes contracted in 1864 while in the line of duty and that the said
disability is of a permanent character, and is not the result of vicious habits, and that it incapacitates him
from the performance of manual labor in such a degree as to render him unable to earn a support, and that
this declaration is made for the purpose of being placed upon the pension roll, under the provisions of the
Act of June 27, 1890. That he ahs not been employed in the military or naval service otherwise than as
stated above.

He hereby appoints, with full power of substitution and revocation, GEORGE E. LEMON, OF
WASHINGTON, D.C., his true and lawful Attorney, to prosecute his claim. That he has not received but
has applied for a pension. That his Postoffice address is Fredonia, County of Mason, State of Texas.

by Certificate number 684050, and duly enrolled at the Knoxville Pension Agency, at the rate of Eight ($8)
dollars per month, having served in the military service of the United States Pvt. Co. G 1 Ala. Cav.; that his
present physical condition is such that he believes himself entitled to receive an increased rate for his
pensioned disabilities, Disease of eyes. Application is also hereby made for additional pension by reason
of the following-named new disabilities for which he is not pensioned Disease of kidneys.

He hereby appoints, with full power of substitution and revocation, GEORGE E. LEMON, OF
WASHINGTON, D.C., his true and lawful Attorney, to prosecute his claim; and in consideration of
services done and to be done in the premises, he hereby agrees to allow his said Attorney, George E.
Lemon, a fee of ten dollars, payable only in the event of the allowance of the claim by the Commissioner of

It is alleged that Andrew P. Flanagin enlisted Apl 24, 1864 and served as a private in Co. G, 1 Reg't Ala
Cavy and was discharged at Hunstville, Ala., Oct 20, 1865.
It is also alleged that while on duty at Kennesaw Mountain, Ga, on or about May, 1864, he was disabled
by Disease of eyes and was treated in hospitals of which the names, locations, and dates of treatment are as
follows: Regimental.
In case of the above-named soldier the War Department is requested to furnish an official statement of
the enrollment, discharge, and record of service so far as the same may be applicable to the foregoing
allegation, together with full medical history. Please give the rank he held at the time he is claimed to have
incurred the disability alleged, and if records show that he was not in line of duty during that period, let the
fact be stated.

personally came before me, a Justice of the Peace in and for the aforesaid County and State, Jefferson W.
Kirkland, of Paint Rock, County of Roane, State of Tenn., who, being duly sworn, declares in relation to
the aforesaid claim that his age is 44 years; that he is the identical person who served as a Private in Co. G,
1 Reg't Ala. Cav. Vols., and knows the above soldier, who was a member of Co. G, 1 Reg't, Ala. Cav.; that
on or about some day of June, 1864, while in the line of duty, and without fault or improper conduct on his
part, at or near Kennesaw Mountain, State of Georgia, said soldier incurred malignant and inveterate sore
eyes; that affiant knows this because he and said Flanagin belonged to the same mess and were on duty
together at the time of the appearance of said disease, which in affiant's opinion has the result of exposure
incidental to the service; that said Flanagin's eyes contained sore up to the time of the muster out of said
company about October, 1865; that he visited Mr. Flanagin at his home near Scottsboro, Jackson Co., Ala.,
in the autumn of 1866 and saw from personal observation that he was still suffering from disease of the
eyes, which was at that time badly influenced, said Flanagin complaining of impaired vision and pain in
those organs; all of which statement is made from affiant's observation and personal knowledge from
association with said Flanagin; that affiant does not write this himself because of his inability to write so it
can be understood.

Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes the above
statement from personal knowledge as above herein was fully set forth.

Affiant's Post-Office address is as follows: Paint Rock, Roane Co., Tenn.

In reply to your request I have to state that Andrew P. Flanagin was a soldier in Co. G. 1st Alabama Reg't.
And I was personally acquainted with him when in comp. at Rome, Ga. The said Flanagin [had] taken
something like sore eyes and when we left Rome, Ga., on march toward Atlanta, Ga., through the cold rains
on or about the last of Sept. 1864 his eyes became worse and continued sore until we were mustered out
Oct. 1865. And I was at his house about twelve months after we were mustered out and his eyes were in a
bad fix. And I am satisfied that it was not his vicious habits.

when he was mustered into duty and at that time his eyes were sound and well and some time during a
march with Sherman to Atlanta he incurred sore eyes. I saw said soldier a short time before his discharge
and his eyes were still sore. My source of knowledge was derived from me being present in the same Co.
with him.

Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes the above
statement from personal knowledge and observation.

aforesaid claim that his age is 63 years; that he is the identical person who served as a Private in Co. G, 1st
Reg't Alabama Cav. Vols., and knows the above soldier, who was a member of Co. G, 1st Reg't, Ala. Cav.;
that on or about 1st day of July, 1864, while in the line of duty, and without fault or improper conduct on
his part, at or near Kennesaw Mountain, State of Georgia, said soldier incurred sore eyes caused by
exposure to bad, rainy weather while out on picket duty. The affiant states that the soldier's eyes remained
sore until he was discharged and that he and the soldier were discharged each of them at the same date and
the soldier's eyes were still sore but the soldier was free from any disability at his enlistment. The affiant
states that he knows these facts from personal observation being an eye witness to the same and that each of
them was under command of their company at that time.

Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes the above
statement from personal knowledge being well acquainted with him in the service of the U.S. Army.

me, a Clerk of the County Court in and for aforesaid County and State, Luke Sanders, whose age is 70
years and who resides in Eden, Concho County, Texas, and whose Post Office address is Eden, Texas
A person of lawful age, who, being duly sworn, declares in relation to the aforesaid case as follows:
I have been acquainted with Andrew P. Flanagin ever since some time in 1866 and ever since I knew him
he has been afflicted with sore eyes. I have lived a neighbor to him the most of the time in 1866 and '67
and '68 and '69 and '71 and '72 and '73 and '74 and '75 and '77 and '78 and '79 and '80 and '81 and '82
and '83 and '85. I lived not exceeding 5 miles of him and I seen him every month or two and he suffered a
good deal with sore eye. I have seen him nearly blind with the sore eyes they are the worst in the warm
season of the year. I cannot say how much of the time he has lost but I know he works when he could
hardly see. He is a man that wants to make an honest living and he has to work for it. I seen him last
summer and he could hardly see. He said to me he had suffered a good deal. I further declare that I have
no interest in said case, and I am not concerned in its prosecution.

me, a Clerk of the County Court in and for aforesaid County and State, D. A. Edmiston, 50 years of age
residing in Paint Rock, Concho County, Texas, and whose Post Office address is Paint Rock, Texas
I first got acquainted with the aforesaid Andrew P. Flanagin in February 1877 and his eyes were diseased
then. I lived a neighbor to him 'till October 1886. Part of the time mentioned above I lived about 5 miles
of him and part of the time a door neighbor 1877 and '78. I lived in a 1/2 mile of him in 1879. I lived 5
miles of him in Sept. We moved together and I lived a door neighbor to him 'till 1886 and he had sore eyes
all the time. They were very bad in the warm season of the year. He had to lose a good deal of his time on
account of his eyes being sore. Part of the time he could hardly see. He were not able to do good labor at
least 1/4 of the time mentioned above. I have seen him but 1 time since 1886 and that were about a year ago
and he could not see how to work any then and I further declare that I have no interest in said case, and I
am not concerned in its prosection.

Notary Public in and for aforesaid County and State, Vincent Holt, Age 55 years P.O. Address, Fredonia,
Mason County Texas.
I have been acquainted with Andrew P. Flanagin ever since about March 1877. I lived a neighbor to him in
1877 and 1878 and 1879 and he were afflicted with sore eyes all the time. I never employed and never
worked any with him. I seen every week or two and his eyes were sore all the time. I lived in about 2 miles
of him the 3 years mentioned above. My age were at that time 42 and occupation were raising stock during
the time mentioned above I cannot say how much of his time he had to lose but I have seen him at times
when he were not able to do any work. I never seen him from about Sept. 1879 'till about 3 years ago and
his eyes were still sore and worse than they were when I seen him last and he said to me that they had been
bad all the time and I have seen him every month or so and his eyes has been very bad at times.

I further declare that I have no interest in said case, and am not concerned in its prosecution.

When did you first seen claimant after he returned from the army, and how do you fix the date?
Answer: I seen him in 1877 after the war. He was then complaining with his eyes.

Of what disability did he complain, and how was he affected?
Answer: No disability except his eyes that I knew of.

How frequently have you seen him since your first acquaintance?
Answer: After 1879 never seen until 1888.

If he has continued to suffer with such disability, please describe the symptoms which were apparent to
you, and state to what extend he has been disabled for manual labor thereby during each year?
Answer: As far his suffering with any disability I never knew anything about except his eyes. That was all
I knew of at any time.

My means of knowing the facts of the case are these:
All that I knew in regards to facts are from what he tells me.

A person of lawful age, who, being duly sworn, declares in relation to the aforesaid case as follows:
I have been acquainted with Andrew P. Flanagin ever since before the war and he had as good eyes as
anybody when he went in the service. I seen him when he came home on a 10 days pass in the summer of
1865 and he had the red sore eyes and he also had them when he came home from service. I lived in about
3 miles of him in 1866 and I seen him every week or two and his eyes were sore all summer and I lived
with him in 1867 and they were sore all the summer in 1868 and 1869. I saws him every once in a while
and at times he had sore eyes but I don't know what time he lost
Further declare that I have no interest in said case, and I am not concerned in its prosecution.

Public in and for aforesaid County and State, W. M. Vaughan, a resident of Fredonia of the County of
Mason, State of Texas, who, being duly sworn, declares in relation to the aforesaid case as follows:

1 I have been practicing medicine 8 years.
2 I did not know him before enlistment.
3 I did not treat him during enlistment nor at home on a furlough.
4 I have treated him since his discharge.
(1) Treated him first about July 1st 1887.
(2) He had granulated sore eyes.
(3) I have treated him since about July 1st 1887. I can't give date of prescription for I haven't them on file
and I never did visit him.
5 The claimant has been disabled for manual labor about one half of the time that I have been treating him.
That is about half of each year the warm seasons. I state above he has been disabled about half of the time
but he works about 2/3 of the year. He is a poor man and has to work this amount of time though he be
disabled to support his family.

And he further declares that he has no interest in said case and is not concerned in its prosecution.

I have been practicing medicine 11 years. I first knew the soldier about Jan. 1st, 1887. I first treated him
professionally about March, 1887.

I have know n the above named soldier for about 6 yrs. And at the time I first knew him he was suffering
with chronic granulated sore eyes and have treated the aforenamed soldier 10 or 12 times for the eye mater.
Also I have treated him for lagrippe and as a sequel he has chronic cystitis and (lumbago) rheumatism of
the muscles of the hip and back and c_. Also the eyes are a great deal worse than they were when last
examined. I think he is entitled to first class rating.

And he further declares that he has no interest in said case and is not concerned in its prosecution.

I have been practicing medicine 12 years. I first knew the soldier about January, 1887. I first treated him
professionally about May, 1887.

I have been practicing for Mr. Flanagin about 6 years. 6 years next month I treated him for granulated sore
eyes, which trouble he has been suffering of until the present date. The eyes are now worse than they were
the first time I treated them. March 1892 I treated him for cata???hal cystitis and chronic muscular
rheumatism. I think the cystitis was caused from Lagrippe he had a few weeks before, but called no
physician. He is no better of the above troubles now than he was March 1892, his troubles are stubborn
and I don't think he could be radical case. Mr. Flanagin takes but little physic to be in his condition, he
either has but little faith in physic or his finance will not admit. I think the latter is the case and he won't
get them unless he could see the way to pay for them. I think really he is total incapacitated for work and
therefore ought to have $30.00 per month.

PROOF OF PHYSICAL DISABILITY-Act of June 27, 1890.

In the Pension Claim No. 684050 of Andrew P. Flanagin late of Co. G 1 Reg. Ala. Cav. Personally came
before me, a Notary Public in and for the aforesaid County and State, R. J. Baze, M.D., a resident of
Mason, whose Post Office address is Mason, Mason Co., Texas, well known to me to be reputable and
entitled to credit, and who, being duly sworn, declares, in relation to the aforesaid case as follows:

That he is a Practicing Physician, and that he has been acquainted with said soldier for about 3 years, and
that he is suffering from chronic inflammation of the eyes both inflamed in the lids and eye proper the
inflammation attacking the iris mostly causing a clear case of chronic iritis. He also has inflammation of
the cornea and conjunctiva causing k???atitis and conjunctivitis. His eyes are in such a state of chronic
inflammation as to render him totally disabled to perform manual labor for 2/3 of his time during summer
and fall months and 1/2 his time during the winter and spring months. I have examined his eyes carefully
and find the inflammation extended so as to render them incurable and in addition to knowing him for 3
years I have treated him during that time for chronic sore eyes. That this affidavit was written by affiant
himself at his office in Mason, Texas this 29th day of December 1894 and in making the same he did not
use and was not aided or prompted by any written or printed statement or recital prepared or dictated by
any other person and not attached as an exhibit to his testimony.

He further declares that he has been a practitioner of medicine for 5 years, and that he has no interest, either
direct or indirect, in the prosecution of this claim.

I hereby certify that in compliance with the requirements of the law I have carefully examined this
applicant, who states that he is suffering from the following disability, incurred in the service, viz: disease
of the eyes, and that he receives a pension of <blank> dollars per month.

He makes the following statement upon which he bases his claim for original pension. That while on
picket duty a dark rainy night near Kennesaw Mountain, Geo. In June 1864, his eyes became affected by
some kind of disease, which has existed to the present time, causing, he believes, half disability to do
manual labor.

Upon examination I find the following objective conditions: Pulse rate, 66; respiration, 16; temperature, 98
1/2; height, 5 feet 10 inches; weight, 161 pounds; age, 46 years.
By Snellins test the vision of claimant's left eye is 15/40 right 15/50. He has conjunctivitis with much
hyperemia, and hypertroptry, especially the palpebral conjunctiva is greatly thickened. These are
granulating, not mus??? ho???. They blink on the slightest irritation. The cornea seem to be unaffected
except a few enlarged blood vessels can be seen in the upper portion of the left. No other disability is
found to exist.

He is, in my opinion, entitled to a 6/18 rating for the disability caused by disease of eyes.

We hereby certify that in compliance with the requirements of the law wehave carefully examined this
applicant, who states that he is suffering from the following disability, incurred in the service, viz: disease
of disease of eyes and kidneys, and that he receives a pension of Eight dollars per month.

He makes the following statement upon which he bases his claim for increase. In 1864 while on duty my
eyes got sore, and have been sore off and on ever since, always worse during hot weather. My kidneys
have hurt for a long time and there are times when I am unable to be up; cannot work at any thing except to
plow.

Upon examination we find the following objective conditions: Pulse rate, 84; respiration, 19; temperature,
100; height, 5 feet 10 inches; weight, 165 pounds; age, 47 years.
General appearance healthy, nutrition good. Chest full round and symmetrical. Auscultation and
percussion give normal vesicular resonance and murmur over all portions of both lungs. Heart's action
normal. Rhythm regular, position normal. There is no disease of lungs or heart. He complains of pain in
lumbar and sacral region when he works or stoops down. There is no swelling or atrophy no pain on
pressure. There is no crepitation or any sign of rheumatism in any joint. Joints, muscles and tendons are
healthy. Examination of urine color yellow straw spes. Gr. 1018 reaction acid. No albumen, no sugar by
Fehlings test. There is no disease of bladder or genital organs. He bases kidney disease on pain in lumbar
organs. Upon examination of the eyes, we find an old case of trachoma. On the inner margin of cornea in
left eye there is a swelling about as large as a wheat corn. The swelling is in the cornea. There is opacity
of the cornea of left eye. Right eye cornea clear. Internal structures of both eyes normal. Vision in left eye
15/cc, vision in right eye 15/30. Rating eight eighteen for disease of eyes. Otherwise no disability exists.

He is, in our opinion, entitled to a 8/18 rating for the disability caused by disease of eyes.
