County of Burnet    In Matter of the Estate of Thomas J. Moore, Deceased

Application for Letters of Administration, Filed Feby. 3/88.

To the Hon. County Court in and for said County:
Your petitioner, Sarah Moore, shows to the court that she resides in Burnet County, Texas.  That on the 11th day of June A.D. 1887, Thomas J. Moore, who at and before his death had his domicile in the county of Burnet aforesaid & died in said County intestate on said 11th day of June A.D. 1887.

That at the time of the death of said Thomas J. Moore, he & your petioner [petitioner] was seized & possessed of a community interest in Real & personal property of the probable value of Twelve hundred dollars in Burnet Co. Texas.  That there is a necessity for an Administration upon the Estate of said Thomas J. Moore in this: That said Moore at the time of his death was indebted to S. E. Holland & to J. S. Hansford & Co. in about the sum of Three hundred dollars.

Wherefore petitioner prays that citation be issued to all parties interested in said Estate as required by law.  That letters of Administration be issued to your petioner [petitioner] & that such other & further orders be made as to the court may seem proper.

Burnet County             To all persons interested in the Estate of Thomas J. Moore, deceased.

Know Ye, that Sarah Moore has filed in the County Court of Burnet County her application for letters of Administration upon the said Estate, which will be heard at the court house thereof on the 3rd Monday in Feby. 1888, at which time all persons interested may appear and contest said application if they see proper.

Bond

The State of Texas
County of Burnet        Whereas Sarah Moore has been appointed by the County Court of Burnet County Administratrix of the Estate of T. J. Moore, Dec’d. and Whereas the Bond of said Administratrix has been fixed by the County Court of said Burnet County at the sum of Twenty four hundred dollars;

Now, therefore, We, Sarah Moore, as principal and R. Livingston and D. R. Moore as sureties, acknowledge ourselves to own & be indebted to J. A. Crews County Judge of Burnet County & to his successors in office in the sum of Twenty four hundred dollars.  Conditioned that the above bound Sarah Moore, shall well & truly perform all the duties required of her under said appointment.

Witness our hands this the 25th day of June A.D. 1888.

Oath

Application to Sell Real Estate

No. 233.  Estate of Thos. J. Moore, Deceased.

In matter of the Estate of T. J. Moore, deceased, Pending in the County Court of Burnet County, Texas, Feb. term A.D. 1890.  To the Hon. R. W. Cates, Judge of said Court.  Sarah J. Moore, Admx. of the Estate of T. J. Moore, deceased, would respectfully show that it is necessary to sell a portion of the real Estate belonging to the Estate of T. J. Moore, Decd. That it is necessary to sell said real Estate to pay the debts of said T. J. Moore, Decd. This Admx., not having any funds on hands with which to pay off and discharge said indebtedness that all of the personal property belonging to said Estate, has been sold & the proceeds of the sale thereof and of previous sales of land are insufficient therefor and said Admx. refers to the sworn Exhibit hereto attached and made a part of this Application to show more fully the necessity of said sale, and said Admx. further shows that it would be more advantageous to the Estate of said T. J. Moore to sell the tract of land described as follows to wit: 

One hundred and twenty five acres a part of the Wm. Aikin Survey beginning at the N.E. Corner of said Wm. Aikin Survey at a stake in the W. line of the Wm. Slaughter league.  Thence with the N. line of said Aikin Survey in a westerly direction to a stake in the North line of said Aikin Survey thence in a Southerly direction to a point in the South line of the said Aikin Survey.  Thence in an Easterly direction to a point in the West line of the Wm. Slaughter league.  Thence in a Northerly direction with West line of said Slaughter league to the Beginning the lines to be run so as to include 125 acres of land.  And further, that said Sale should be made at private Sale for cash in hand.  Wherefore admx. asks that Citation issue as required by law and for an order authorizing her to make sale of the land.

And now comes Sahra [Sarah] Moore Administratrix of the Estate of T. J. Moore deceased and now here files in this Court the following Exhibit of the condition of the Estate of the said T. J. Moore decd.

Property on hand at time of the issuance of letters of administration as shown by inventory filed in this cause on the 25th day of June, A.D. 1888.

Real Estate.
480 acres the Wm. Aiken Survey (Including the Homestead of this Admx. & T. J. Moore decd.  Value in the inventory at the Sum of

$ 960.00
Personal Property.

2 Head of Horses valued in inventory at the sum of 40.00
10 cattle valued in inventory at the sum of 50.00
12 Hogs valued in inventory at the sum of 10.50
1 Wagon valued in inventory at the sum of 20.00

        Total Value of Estate   $1080.00

The said administrator further shows the following indebtedness has been presented and allowed by her as Just debts against the Estate of the said T. J. Moore, Viz:

Note given by said Moore to Hansford and Co. dated April 21st 1886 bearing 12% interest   $ 16.10
Account of Hansford & Co. for Goods   153.00
Note of S. E. Holland for the sum  189.42

$358.52

The said Administrator further shows that she was paid off & discharge the following indebtedness, Viz:

To T. E. Hammond Atty. For Estate   $30.00
To Dr. S. H. Hoover Medical Service rendered T. J. Moore last illness  35.00

$65.00

The said Admx. further represents that she has made application to sell at private sale 125 acres of the 480 acres inventoried above in order to pay off and discharge the indebtedness mentioned above and that after said indebtedness is paid she will have in her hands remaining of the Estate administered by her the following assets, Viz:

1st.  355 acres of the Wm. Aikin Survey (200 acres of which is the Homestead of herself and her deceased husband T. J. Moore

2nd. The personal property inventoried in the inventory of the Estate.

The said Admx. Further represents that she has never had set aside the allowance allowed by law, to herself and minor children, six in number, the oldest of which is seventeen years of age, that she has never had the exemptions allowed by law set aside to her and her said family and that she and her said family has never had their homestead set aside and alloted to them.  The said Admx. Now here asks that she be allowed the sum of one thousand Dollars as an allowance for the maintenance of her self and minor children.  That 5 cows & calves, 2 horses & wagon and the hogs mentioned in the inventory be set aside to her as exempt property.  That 200 acres including improvements of the land mentioned in the inventory of the Estate be set aside to this Admx. & her said Children and that the balance of the real Estate mentioned in the inventory of the Estate after deducting the two hundred Acres as a homestead & after deducting the 125 acres for the sale of which application has been made together with the personal property mentioned in said inventory not set aside to this applicant as exempted property be ordered to be sold to pay the allowance prayed for by this applicant.  The Admx. Says that the above and foregoing is full and complete statement of the matters and things to which it relates.

    To the Sheriff or any constable of Burnet County Greeting.

    You are hereby commanded to cause to be posted in three of the most public places in your county one of which shall be at the court house door and no two in the same City, town or village, copies of the following notice.

The State of Texas    ) In the County Court February Term A.D. 1890
County of Burnet    ) To all whom these presents may come Greeting:  Know ye that Mrs. Sarah Moore Administratrix of the Estate of Thomas J. Moore deceased, having on the 22nd day of Jany. A.D. 1890 filed in the County Court of Burnet County, Texas her application to sell the following described land belonging to an Estate lying and being situate in the County of Burnet in the State of Texas and being 125 acres out of the Eastern part of the Wm. Aikin Survey and being a part of the 480 acres of land heretofore mentioned as a part of said Estate.

Now therefore these are to notify all persons interested in said Estate to be and personally appear at the next regular term of the Hon. County Court to be holder thereof in the Court house at the City of Burnet on the 3rd Monday in February A.D. 1890 same being the 17th day of the month, and then and there to show cause why such sale should not be made – should they choose to do so.

No. 233 Report of Sale

In matter of the Estate of Thos. J. Moore, pending in County court of Burnet County, May Term A.D. 1890

To the Hon. R. W. Cates, Judge of said court:

Now comes Sarah Moore, administratrix of the Estate of T J. Moore, deceased, and respectfully reports that in obedience to an order of this court, made and entered in said administration on the 21st day of February A.D. 1890, has sold at private sale on the 29th day of April A.D. 1890, the following described lands and premises, to-wit: 

Being a part of the Wm. Aiken Survey in Backbone Valley in Burnet County, Texas, more particularly described as follows: Beginning at the N.E. corner of said Aiken Survey at a stake in the upper line of the Wm. Slaughter League from which a post oak [undeciphered] S. 62W. 4 vsd. Do. N. 48E 9 vrs.  Thence N. 60W. 700 vrs. A Stake from which a post oak [undeciphered] S. 54 W. 8 2/5 vrs. Do. S. 32 E. 4 2/5 vs.  Thence S. 30 W. at 444 vs. a cr. At 1008 vs. a stake in line of said Aiken Survey, from which a post oak [undeciphered] S. 71 ½ W. 2 2/5 vrs. Do. S. 35 ½ W. 5 4/5 vs.  Thence S. 60 E. 700 vrs. To S.E. cor. of said Aiken Survey on Slaughter line, a stone mound whence a post oak [undeciphered] N. 65 W. 1 ¾ vs. do. N. 72 E. 1 ½ vs.  Thence N. 30 E. 1008 vs. with the line of said Slaughter league to the place of beginning containing one hundred and twenty five acres.

That said land was sold at private sale in Backbone Valley in Burnet County, Texas, on the day and date aforesaid.

That J. P. Hansford became the purchaser of said land at the following consideration, to-wit:

There being an indebtedness against said Estate as shown by last annual exhibit filed in this court on the 27th day of January A.D. 1890, as follows:

Note given by T. J. Moore to Hansford & Co. dated April 21st 1886, bearing 12% interest for the sum of
$  16.00

Account of Hansford & Co. for goods  153.00
Note held by S. E. Holland for the sum of  189.42


Amounting in the aggregate to the sum of Three hundred and fifty eight dollars and fifty two cents, exclusive of interest.  The said J. P. Hansford agrees to pay off and discharge said Notes and accounts and release said estate from all claims and liabilities by reason of said indebtedness as foresaid and to pay all court costs incurred in making said sale.

The said purchaser, J. P. Hansford is ready and willing to comply with the terms of said sale whenever the same shall have been confirmed.

Said Administratrix, now, therefore, asks that said sale be approved and that the proper decree be made by this court as the law in such cases made and provided.

The said Administrtrix now here states that the above and foregoing contains a true and correct statement of the matters to which it relates.
